Terms and Conditions
1. Introduction
These Terms and Conditions (“Agreement”) govern all sales, commissions, and related services provided by the Artist. By purchasing, commissioning, or otherwise engaging with the Artist’s work, the Client agrees to be bound by these terms.
2. Ownership and Copyright

All artworks (including commissioned pieces) are protected by copyright law.

Unless otherwise agreed in writing, the Artist retains full copyright and all reproduction rights.

The Client may not reproduce, distribute, or use the artwork for commercial purposes without written consent.

The Artist reserves the right to display images of the work (including commissioned pieces) in their portfolio, website, social media, exhibitions, or publications.
3. Commissioned Work
3.1 Process

Client provides written brief/details.

Artist provides an estimated timeline and quote.

Work begins after receipt of a non-refundable 50% deposit.
3.2 Revisions
-
The price does not include revisions as all pieces are custom, one of a kind..

Additional changes upon completion shall be deemed “beyond the agreed scope” and will be billed at an additional fee at no less than 25% of the total sales price.
3.3 Completion & Delivery

Final payment is due before delivery.

Artwork is delivered in the agreed format.

If shipping is required, costs and insurance are the Client’s responsibility unless otherwise stated.
4. Payment Terms

Payments are due as invoiced.

Late payments may incur a fee of [e.g., 8.75% per month].

All deposits are non-refundable unless the Artist cancels the project.
5. Pricing & Quotes

All quotes are valid for 5 Business Days.

Prices exclude taxes, duties, or shipping unless stated otherwise.
6. Cancellations & Refunds

By Client: If the Client cancels after work has begun, the deposit is forfeited. Any completed portion may be invoiced.

By Artist: If the Artist cancels before completion, the Client will receive a refund of any payments made, minus expenses already incurred.
7. Risk & Shipping

The Client assumes responsibility once artwork is shipped.

The Artist is not responsible for loss or damage during shipping.
8. Display & Credit

The Client agrees to credit the Artist when the artwork is publicly displayed (online or offline).

For digital commissions, credit should include a link to the Artist’s website or social handle.
9. Limitation of Liability
The Artist shall be held harmless and not liable for any claim arising out of this Agreement.
10. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of New York USA without regard to conflict of law rules.
